Data Specialists Group LLC, doing business as DateGuard (“DateGuard,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the DateGuard website, mobile application, verification features, safety-check services, paid plans, or other services that link to this Policy (collectively, the “Services”).
Please read this Policy carefully. By using the Services, you acknowledge the practices described here. Where consent is required by law—especially for biometric or voice-data processing—we will ask for it separately before that processing begins.
The controller of personal information described in this Policy is Data Specialists Group LLC (DBA DateGuard). For questions, requests, or concerns about this Policy or our privacy practices, contact us at [email protected].
This Policy does not govern the privacy practices of third-party sites, dating platforms, or other services that may link to or from the Services. Their privacy practices are governed by their own notices.
DateGuard provides tools designed to help users verify dating profiles and make more informed dating-safety decisions. Depending on the feature or plan selected, the Services may include liveness verification, dating-profile verification, safety or background checks, and optional vocal biomarker analysis.
Our current offerings may include:
Prices, features, and availability may change. Payment and subscription terms presented at checkout also apply to a purchase.
We collect personal information from you, automatically from your use of the Services, and from service providers that help us provide requested features.
Depending on how you use the Services, this may include:
Please do not provide information about another person unless you have a lawful basis and any permission required to do so.
If you elect to use liveness verification, we collect and transmit a selfie, camera image, or video input for the limited purpose of determining whether a live person is present and helping prevent spoofing, replay, or manipulated-image attempts. Depending on applicable law and the technology used, this processing may involve information derived from facial imagery that is treated as biometric information, a biometric identifier, or biometric data.
If you elect to use Vocal Bio or another vocal biomarker-analysis feature, we collect a brief voice recording or sample for the limited purpose of providing the requested analysis. Depending on applicable law and the technology used, a voice sample or information derived from it may be treated as biometric information or sensitive personal information.
We seek your express, affirmative consent before collecting or processing biometric or voice-related information where required. You may decline or withdraw consent; however, the affected liveness or vocal-analysis feature will not be available without the processing necessary to provide it. Withdrawal does not affect processing that occurred before it was withdrawn.
When you access the Services, we or our providers may collect limited technical and usage information, such as IP address, device type, browser type, operating system, approximate location derived from IP address, pages or screens viewed, interactions, referring URLs, and dates and times of access. We use this information to operate, secure, troubleshoot, understand, and improve the Services.
We may receive information from providers that assist with a transaction, authentication, fraud prevention, liveness verification, vocal analysis, hosting, analytics, or a safety/background check. The information received is limited to what is reasonably necessary to provide the requested Service, such as a verification or processing result, transaction status, or safety-check result.
We use personal information as necessary to:
Vocal-analysis outputs are informational and are not medical, mental-health, diagnostic, employment, credit, housing, insurance, or law-enforcement determinations. DateGuard does not represent that a verification, safety check, or analysis can guarantee a person’s identity, safety, intent, honesty, compatibility, or conduct. Users should continue to use independent judgment and appropriate safety practices.
If you are in the European Economic Area (“EEA”), United Kingdom, or another jurisdiction with similar requirements, we process personal information only when we have a valid legal basis. Depending on the context, that basis is:
We do not sell personal information for money. We do not disclose biometric identifiers or biometric information for profit. We share personal information only as described below or with your direction or consent:
We do not use or disclose sensitive personal information for purposes that California law describes as requiring a right to limit, except as necessary to provide requested Services, for security and fraud prevention, or as otherwise permitted by law. We do not knowingly sell or share the personal information of consumers under 18 years of age.
This section provides notice about our biometric practices, including for Illinois residents. It is intended to supplement, not replace, any separate biometric consent or written release presented before collection.
For users who choose liveness verification, DateGuard and Facia.ai may process facial imagery and information derived from that imagery, including facial geometry or facial-scan information where applicable, to verify liveness and help detect spoofing or manipulated content. For users who choose Vocal Bio, DateGuard and Emotion Logic may process a voice recording or information derived from it to provide the requested vocal analysis. We process this information only to provide the feature you request, maintain its security and integrity, prevent fraud or abuse, and meet legal obligations.
Before collecting or obtaining biometric identifiers or biometric information where required, we will provide notice and obtain your informed written or electronic release/consent. You are not required to use these features. If you do not consent, or later withdraw consent, we will not be able to provide the relevant liveness-verification or vocal-analysis feature.
DateGuard does not permanently store raw selfies, facial images, facial templates, voice recordings, or voiceprints used for these features. They are processed transiently by the applicable provider to perform the requested check or analysis and are deleted or discarded after processing in accordance with our providers’ applicable retention practices and legal obligations. DateGuard may retain non-biometric verification status, timestamps, limited account information, and, for vocal analysis, a resulting aggregate analysis output, for as long as reasonably necessary to operate your account and Services, resolve disputes, enforce agreements, and comply with law, unless you request deletion or a longer period is legally required.
To the extent DateGuard possesses biometric identifiers or biometric information, DateGuard will permanently destroy it on or before the earlier of: (1) when the initial purpose for collecting or obtaining it has been satisfied; or (2) within three years of your last interaction with DateGuard. This schedule is subject to any longer period strictly required by applicable law or necessary to establish, exercise, or defend legal claims. We require processors handling biometric information on our behalf to process and retain it only as necessary to provide the requested feature and in accordance with applicable law and their contractual obligations to us.
We do not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information. We do not disclose biometric identifiers or biometric information except to our processors (including Facia.ai or Emotion Logic) as needed to provide the requested feature, with your consent, to complete a financial transaction you authorize, when required by law or legal process, or as otherwise permitted by applicable law. We require reasonable safeguards from processors handling such data.
We retain account and service information while your account is active and thereafter only for as long as reasonably necessary for the purposes described in this Policy, including maintaining your account and verification status, providing requested Services, processing transactions, meeting legal, accounting, and tax obligations, resolving disputes, enforcing agreements, and protecting the Services.
As stated above, DateGuard does not permanently retain raw biometric facial data or raw voice recordings used for liveness or vocal analysis. When information is no longer needed, we delete, anonymize, aggregate, or otherwise de-identify it, subject to technical limitations, legal requirements, and legitimate recordkeeping needs.
You may request deletion of your account data by contacting [email protected] with the subject line “Delete My Data.” We will review and respond to verified requests within the time required by applicable law. We may retain limited information where necessary to comply with law, resolve disputes, enforce agreements, prevent fraud, or maintain security.
We use reasonable administrative, technical, and organizational measures designed to protect personal information, including encrypted transmission where appropriate and access controls intended to limit access to authorized personnel and service providers. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly of suspected unauthorized access.
Depending on where you live, you may have rights regarding your personal information, subject to applicable law and exceptions. These may include the right to:
To exercise a right, email [email protected] and describe your request. We may need to verify your identity before completing a request. You may use an authorized agent where permitted by law; we may request evidence of the agent’s authority and verification of your identity. We will not discriminate against you for exercising applicable privacy rights.
If you are in the EEA or UK, you may also lodge a complaint with your local data-protection supervisory authority. We encourage you to contact us first so we can try to address your concern.
