By accessing or using the DateGuard.AI application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by Data Specialists Group LLC ("Company," "we," "us," or "our").

2. Description of Service

DateGuard.AI is a dating safety application that provides identity verification through advanced liveness detection. The Service confirms that users are real people — not bots, catfish, or fake profiles — by performing a quick, camera-based liveness check. The identity verification feature is provided free of charge.

6. Intellectual Property

All content, features, technology, and functionality of DateGuard.AI — including but not limited to software, algorithms, text, graphics, logos, and trademarks — are the exclusive property of Data Specialists Group LLC and are protected by copyright, trademark, and other intellectual property laws.

7. Pricing & Billing

Plans

DateGuard offers the following plans:

Billing

All paid plans are one-time purchases and do not auto-renew. All payments are processed securely by Stripe, Inc. DateGuard does not store your payment card information.

Cancellation

Since our plans are one-time purchases rather than subscriptions, no cancellation is required. If you believe a charge was made in error, please contact [email protected] within 14 days for a review.

Refunds

Because DateGuard's verification and compatibility features deliver results immediately upon use, purchases are generally non-refundable once the associated service has been consumed. If you experience a technical issue that prevents you from using a purchased feature, contact [email protected] within 14 days and we will review your case on an individual basis.

Price Changes

We reserve the right to modify pricing at any time. We will notify you of material price increases at least 30 days in advance via the email address associated with your account.

9. Disclaimers

DateGuard.AI identity verification confirms liveness only. A verified badge means the user passed a real-time liveness check — it does not guarantee the person’s identity, character, intentions, or background. DateGuard is not a substitute for personal safety precautions.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATA SPECIALISTS GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

11. Termination

We reserve the right to suspend or terminate your access at any time, with or without cause and with or without notice, including for violation of these Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States.

13. Changes to Terms

We may update these Terms from time to time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Criminal Records Search Disclaimer

DateGuard is NOT a Consumer Reporting Agency ("CRA") as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"). The Safety Check feature searches publicly available criminal records for personal dating safety purposes only. You may NOT use DateGuard reports for: (a) employment screening; (b) tenant or housing decisions; (c) credit or insurance underwriting; (d) educational enrollment; (e) any other purpose governed by the FCRA or analogous state laws. Criminal records data is aggregated from public sources and may contain errors, false positives, or matches with individuals other than your intended subject. DateGuard does not independently verify the accuracy of these records and provides them on an AS-IS basis without warranty.

15. Biometric Data

DateGuard collects biometric data (facial geometry scans and/or vocal biomarkers) with your express written consent. 16. Mandatory Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and not in any court of law.

Class Action Waiver: YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any class, consolidated, or representative proceeding.

Exceptions: Either party may bring claims in small claims court if eligible. Nothing in this section prevents you from bringing issues to the attention of federal, state, or local government agencies that may seek relief on your behalf.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

17. Limitation of Liability for Data Accuracy

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATEGUARD AND DATA SPECIALISTS GROUP LLC SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: (A) INACCURATE, INCOMPLETE, OR OUTDATED CRIMINAL RECORDS DATA; (B) FALSE POSITIVE MATCHES OR MISIDENTIFICATION; (C) ANY ACTIONS TAKEN BY YOU OR THIRD PARTIES BASED ON INFORMATION PROVIDED THROUGH THE SERVICE; (D) UNAUTHORIZED USE OF REPORTS FOR PURPOSES PROHIBITED BY THESE TERMS. THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND.
