By accessing or using the DateGuard.AI application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by Data Specialists Group LLC ("Company," "we," "us," or "our").

2. Description of Service

DateGuard.AI is a dating safety application that uses vocal biomarker analysis to provide emotional insight reports. Users record voice samples which are processed through our analysis engine to generate emotional dimension scores and compatibility reports. The Service is intended for personal and informational purposes only.

3. Account Registration & Security

To use DateGuard.AI, you must create an account by providing a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. Pricing & Payment

DateGuard.AI offers the following pricing tiers:

• Single Report: $59 (one-time purchase)
• Elite Monthly: $129/month (up to 3 reports per month)
• Annual Unlimited: $499/year (unlimited reports)
• Payment: All payments are processed securely through Stripe.
• Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
• Refunds: Payments are non-refundable except where required by applicable law. Contact us at [email protected].

5. Voice Recording & Analysis Consent

By using the Service, you expressly consent to:

• Recording voice samples through the application
• The processing and analysis of your voice recordings for vocal biomarker evaluation
• The storage of analysis results associated with your account

You represent that you have obtained appropriate consent from any third party whose voice you record through the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Record individuals without their knowledge or consent where required by law
• Attempt to reverse-engineer, decompile, or extract the underlying algorithms
• Share, resell, or redistribute your account access or analysis reports for commercial purposes
• Use the Service to harass, stalk, or harm another person
• Interfere with or disrupt the integrity or performance of the Service

7. Intellectual Property

All content, features, technology, and functionality of DateGuard.AI — including but not limited to software, algorithms, text, graphics, logos, and trademarks — are the exclusive property of Data Specialists Group LLC and are protected by copyright, trademark, and other intellectual property laws.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

DateGuard.AI is NOT medical, psychological, or professional advice. The vocal biomarker analysis and reports provided by the Service are for informational purposes only.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATA SPECIALISTS GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, including for violation of these Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States. Any legal action shall be brought exclusively in the courts located in Delaware.

13. Changes to Terms

We may update these Terms from time to time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
